How we use your information

This notice explains how Spelt Out uses personal information while we build our service: on this website, in our waiting list and pilot forms, in emails and conversations, on LinkedIn, and when we contact organisations about our pilot. The checking service is not open yet. It will have its own privacy notice before it opens.

Who we are

Spelt Out is a trading name of P. Jacobs, Suite 208, 116 Ballards Lane, London N3 2DN. We decide how your information is used, which makes us its controller. Contact us about anything in this notice at hello@speltout.co.uk.

What we collect, why, and the law we rely on

When you visit this website

Cloudflare, which hosts this website, uses your IP address and basic technical details, such as your browser type, to deliver the pages and protect the site from attacks. It gives us anonymous totals, such as the number of visits each day, which do not identify you. This website sets no cookies and runs no analytics or tracking scripts. Lawful basis: our legitimate interests in running a secure website.

When you join the waiting list

We collect your email address; whether you are a parent, carer, young person or professional; where the plan is in the process; your answers to our questions; whether you would like a conversation; and where you heard about us. Your answers can show that you or your child may have special educational needs or a disability, so we treat them as special category information and ask for your explicit consent. We use them to tell you when we open and, if you agree, to arrange a conversation. Lawful basis: your consent and your explicit consent (UK GDPR articles 6(1)(a) and 9(2)(a)). You can withdraw your consent at any time; this does not affect what we did before.

When you apply to be a pilot partner

We collect your name, organisation, role, work email address and your answers. We use them to contact you about the pilot. Lawful basis: your consent.

When you email us

We use your message and contact details to reply to you. Lawful basis: our legitimate interests in replying to you.

When you use our LinkedIn page

If you follow, react to, comment on or message the Spelt Out page on LinkedIn, we see what you share with the page and use it to reply to you and run the page. LinkedIn also gives us statistics about the page, such as the number of visitors and followers and their job types, which do not name anyone. LinkedIn is responsible for its own platform under its own privacy policy, and for members in the European Economic Area and Switzerland it takes the main responsibility for these statistics under its Page Insights Joint Controller Addendum. Lawful basis: our legitimate interests in running the page and replying to you. You can object at any time.

When we talk to you

If you agree to a conversation, we talk by phone or video call. We take brief notes of your views, with no details about any child, and we do not record calls. If we use a video calling service, it handles the call under its own terms, and we tell you which service when we arrange the call. Lawful basis: your consent if you joined the waiting list; our legitimate interests if you are a professional.

When we contact organisations about our pilot

We email organisations such as SEND law firms, charities and advocacy services at the contact details they publish on their own websites, and we record their replies so we can respect them. Where an address or a reply names a person, that is personal information. Lawful basis: our legitimate interests in finding pilot partners. If you ask us to stop, we will, and we keep a short note of your request so that we do not contact you again.

Please do not send us your child's plan or any details about your child's needs or health. If you do, we will delete them.

Children and young people

Young people aged 16 or over, including those with their own plan, can join the waiting list themselves. If you are under 16, please ask a parent or carer to join instead.

Who handles your information for us

• Tally runs our forms and stores the answers in the European Union. When you open one of our forms you are on Tally's website; Tally's privacy notice says which cookies it uses.
• Zoho provides our email and stores it in the European Union.
• Cloudflare hosts this website and protects it from attacks.

Each handles your information for us under data protection terms. We do not sell your information. We share it only with these providers, or where the law requires it.

Information sent outside the UK

Tally and Zoho keep your information in the European Union, which UK law treats as giving adequate protection. Cloudflare may process it in other countries, protected by the safeguards in its data protection terms.

How long we keep it

• Waiting list and pilot answers: until we open, or 12 months after you sign up, whichever is sooner.
• Emails, LinkedIn messages, conversation notes and the details of organisations we contact: no more than 12 months.
• A note that you asked us not to contact you: for as long as we need it to respect your request.
• Anything sent to us about a child's needs or health: deleted straight away.

Your rights

You can ask us for a copy of your information, and ask us to correct it, delete it or restrict how we use it. You can object to how we use it, including at any time to our emails. Where you gave us information and we rely on your consent, you can ask for it in a portable form. You can withdraw your consent at any time. Email hello@speltout.co.uk and we will reply within one month. We do not make decisions about you by automated means.

Complaints

If you are unhappy with how we have used your information, please tell us first at hello@speltout.co.uk. We will acknowledge your complaint within 30 days and tell you what we will do. You can also complain to the Information Commissioner's Office at ico.org.uk/make-a-complaint or on 0303 123 1113.

Changes to this notice

If what we do changes, we will update this notice and the date at the top.
